Mi ritengo fortunato perch\u00e9, in questo periodo difficile, ho gestito ininterrottamente la mia attivit\u00e0 di avvocato e sono rimasto fisicamente attivo. Vivere in una zona residenziale e costiera aperta mi ha dato l'opportunit\u00e0 di uscire per lunghe corse, senza esporre me o altri al coronavirus, mentre in molte parti del mondo le persone erano confinate nelle loro case. Nella mia professione rappresento clienti di tutto il mondo, in materia di affari e di immigrazione, sia che si tratti di piccoli investitori che espandono la loro attivit\u00e0 in America, sia che si tratti di societ\u00e0 multinazionali che beneficiano della mobilit\u00e0 globale della forza lavoro. Molti dei miei clienti sono stati colpiti in modi diversi da questa pandemia e dai proclami presidenziali che sospendono l'ingresso di persone straniere e limitano la mobilit\u00e0 della loro forza lavoro globale. Il Dipartimento di Stato ha annunciato che alcuni viaggiatori dell'area Schengen possono richiedere un'eccezione di interesse nazionale (\"NIE\") che consente l'ingresso negli Stati Uniti a determinati richiedenti che soddisfano le linee guida NIE.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sfondo<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Dal gennaio 2020, sono stati emessi diversi proclami presidenziali che sospendono l'ingresso degli stranieri che, nei 14 giorni precedenti, sono stati in Cina continentale, Iran, Area Schengen europea, Irlanda o Regno Unito. Il 22 giugno 2020, il Presidente Trump ha emesso un proclama in cui si afferma, tra l'altro, che\u00a0<em>\"l'attuale ammissione di lavoratori all'interno di diverse categorie di visti non immigranti comporta anche il rischio di spostare e svantaggiare i lavoratori statunitensi durante l'attuale ripresa\".<\/em>\u00a0Si tratta di un attacco all'innovazione e alla capacit\u00e0 degli Stati Uniti di trarre vantaggio dall'attrazione di talenti, investitori e capitali in tutto il mondo. In particolare, i programmi per i visti H-1B, L-1A, L-1B ed E-2 sono programmi fondamentali per l'occupazione multinazionale e per l'occupazione dei lavoratori.\u00a0<a href=\"https:\/\/www.cato.org\/blog\/facts-about-l-1-visa-program\" target=\"_blank\" rel=\"noreferrer noopener\">crescita degli investimenti in un mercato sempre pi\u00f9 globale<\/a>Insieme, i proclami estendono il divieto di rilascio dei visti per immigrati e impediscono l'ingresso di cittadini stranieri che richiedono visti di lavoro nelle categorie H-1B, H-2B, L-1, E-2 e molti J-1 insieme alle loro persone a carico fino alla fine del 2020.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La necessit\u00e0 di una mobilit\u00e0 globale<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Esistono numerose aziende con sede negli Stati Uniti gestite da dirigenti, manager, dipendenti di talento e qualificati stranieri con visti L-1A, L-1B, H-1B ed E-2. Questi visti sono un ottimo meccanismo per trasferire o portare in un'affiliata, una filiale, una casa madre o una succursale statunitense di qualsiasi dimensione, dirigenti, manager e dipendenti stranieri in posizioni specializzate che soddisfano i requisiti odierni e arbitrari dei visti. Queste aziende con sede negli Stati Uniti sono finanziate con ingenti investimenti stranieri negli Stati Uniti e offrono opportunit\u00e0 di lavoro ai lavoratori statunitensi. Queste aziende statunitensi non solo stanno facendo ogni sforzo per sopravvivere in questo periodo difficile, ma stanno anche affrontando un ostacolo maggiore a causa dei proclami presidenziali che sospendono l'ingresso negli Stati Uniti di stranieri che rappresentano un rischio per il mercato del lavoro statunitense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Il visto L: L-1A e L-1B<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/l-1a-intracompany-transferee-executive-or-manager\" target=\"_blank\" rel=\"noreferrer noopener\">Il visto L-1 \u00e8 un visto per non immigrati<\/a>&nbsp;che consente alle aziende straniere di trasferire i dipendenti con due tipi di visto L-1. Il visto L-1A consente il trasferimento di dirigenti e manager, compresi i proprietari di aziende, per un massimo di sette anni.&nbsp;<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/l-1b-intracompany-transferee-specialized-knowledge\" target=\"_blank\" rel=\"noreferrer noopener\">Il visto L-1B per i dipendenti con conoscenze specialistiche<\/a>&nbsp;consente l'ingresso per un massimo di cinque anni. Entrambi i visti sono disponibili secondo una serie di regole diverse per le aziende statunitensi nuove o esistenti. Tra gli altri requisiti, il&nbsp;<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/l-1b-intracompany-transferee-specialized-knowledge\" target=\"_blank\" rel=\"noreferrer noopener\">I candidati qualificati devono aver lavorato per una filiale<\/a>, societ\u00e0 madre, affiliata o filiale della societ\u00e0 statunitense al di fuori degli Stati Uniti per almeno un anno degli ultimi tre anni.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Il visto E-2<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Il&nbsp;<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/e-2-treaty-investors\" target=\"_blank\" rel=\"noreferrer noopener\">Visto E-2<\/a>&nbsp;consente a una persona straniera che ha la nazionalit\u00e0 di una&nbsp;<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/us-visas\/visa-information-resources\/fees\/treaty.html\" target=\"_blank\" rel=\"noreferrer noopener\">paese del trattato<\/a>&nbsp;per investire negli Stati Uniti acquistando un'azienda esistente o avviandone una nuova. Questo visto consente inoltre a un'azienda con sede negli Stati Uniti di portare negli Stati Uniti dirigenti o manager stranieri. Sia che il richiedente del visto E-2 sia un dipendente o un investitore, in entrambi i casi il richiedente deve essere della stessa nazionalit\u00e0 dell'azienda statunitense. Il dipendente straniero E-2 pu\u00f2 essere un manager\/supervisore o un lavoratore con competenze speciali che lo rendono essenziale per l'azienda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Visto H-1B<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Il&nbsp;<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/h-1b-specialty-occupations-dod-cooperative-research-and-development-project-workers-and-fashion\" target=\"_blank\" rel=\"noreferrer noopener\">Il visto H-1B \u00e8 un visto temporaneo per non immigrati.<\/a>&nbsp;categoria che consente ai datori di lavoro statunitensi, alla ricerca di lavoratori stranieri altamente qualificati in occupazioni speciali - in particolare nei settori della scienza, della tecnologia, dell'ingegneria e della matematica (STEM) -, di presentare petizioni per lavoratori stranieri qualificati. Ogni anno \u00e8 previsto un tetto massimo di 65.000 visti, con 20.000 visti aggiuntivi per i professionisti stranieri in possesso di un master o di un dottorato conseguito presso un'istituzione statunitense. L'assegnazione dei visti H-1B e la procedura di presentazione delle domande sono controllate dall'USCIS (U.S. Citizenship and Immigration Services). Questi lavoratori stranieri qualificati hanno un'esigenza critica nel mercato del lavoro statunitense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Il divieto di viaggio<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Da quando il COVID 19 ha iniziato a colpire gli Stati Uniti e i Paesi di tutto il mondo, sono state prese diverse misure negli Stati Uniti. Gli Stati Uniti, cos\u00ec come molti Paesi, hanno chiuso le frontiere, rendendo impossibile viaggiare da o verso gli Stati Uniti. I consolati americani in tutto il mondo hanno chiuso le porte e cancellato gli appuntamenti. Le persone in possesso di un visto approvato non hanno potuto prendere appuntamento presso i consolati statunitensi per ottenere il timbro del visto. In altri casi, i titolari di visto che si trovavano temporaneamente all'estero non sono potuti tornare negli Stati Uniti a causa dei proclami presidenziali. Un terzo gruppo di persone che stavano visitando gli Stati Uniti quando le frontiere erano chiuse si aspetta o vuole cambiare lo status del visto.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Consolati e ambasciate statunitensi: Ripresa dei servizi di rilascio dei visti<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A partire dal 20 luglio 2020, molte ambasciate e consolati statunitensi hanno ripreso i servizi di rilascio dei visti, con tempi di attesa in aumento a causa degli arretrati. Le persone con visti approvati dovrebbero controllare il sito&nbsp;<a href=\"https:\/\/www.usembassy.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ambasciata e Consolato degli Stati Uniti<\/a>&nbsp;nel Paese d'origine per l'ultimo appuntamento con il visto.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Eccezione ed espansione dell'interesse nazionale<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Tra gli altri tipi di visto, i titolari di visti H-1B, L-1A, L-1B, E-2 che, al momento della proclamazione presidenziale, si trovavano al di fuori degli Stati Uniti e risiedevano nell'area Schengen, sono soggetti al decreto presidenziale 10052. Tale proclama proroga il proclama presidenziale 10014, che sospendeva l'ingresso negli Stati Uniti di alcuni richiedenti il visto di immigrazione, fino al 31 dicembre 2020. Tuttavia, a partire dal 12 agosto 2020 e dall'espansione del 25 agosto 2020, alcuni immigrati possono richiedere un'eccezione di interesse nazionale (NIE) se rientrano nelle eccezioni elencate. La nuova espansione NIE consente ai funzionari consolari di rinunciare al requisito del colloquio di persona per le persone che richiedono un visto per non immigrati nella stessa classificazione.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Eccezioni: Richiedenti L-1A<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Un richiedente di un visto L-1A pu\u00f2 essere idoneo a ricevere un NIE se intende riprendere un impiego continuativo negli Stati Uniti nella stessa posizione con lo stesso datore di lavoro e la stessa classificazione di visto.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Un'altra eccezione \u00e8 rappresentata dal fatto che un richiedente di un visto L-1A (il L-1A per nuovi uffici \u00e8 escluso) pu\u00f2 essere idoneo per un NIE se \u00e8 un dirigente o un manager di alto livello e soddisfa due dei seguenti criteri:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Il candidato dovr\u00e0 essere un dirigente o un manager di alto livello.<\/li>\n\n\n\n<li>Il richiedente ha trascorso diversi anni con l'azienda all'estero, indicando una conoscenza e un'esperienza sostanziale all'interno dell'organizzazione che pu\u00f2 essere replicata solo da un nuovo dipendente all'interno dell'azienda dopo una formazione approfondita che causerebbe difficolt\u00e0 finanziarie al datore di lavoro.<\/li>\n\n\n\n<li>Il richiedente soddisfer\u00e0 un'esigenza aziendale critica per il datore di lavoro che soddisfa un'esigenza infrastrutturale critica in un settore designato (descritto sopra).<br><\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Eccezioni: Richiedenti L-1B<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Un richiedente L-2A pu\u00f2 anche essere idoneo per un NIE se sta cercando di riprendere un lavoro in corso negli Stati Uniti nella stessa posizione con lo stesso datore di lavoro e la stessa classificazione di visto. Costringere i datori di lavoro a sostituire i dipendenti in questa situazione pu\u00f2 causare indebite difficolt\u00e0 finanziarie.<br>Un'altra eccezione \u00e8 rappresentata dal caso in cui il richiedente sia un esperto tecnico o uno specialista che risponde a un'esigenza di infrastruttura critica. Il funzionario consolare pu\u00f2 stabilire che un richiedente L-1B rientra in questa categoria se sono presenti tutti e tre i seguenti indicatori:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Le mansioni proposte dal richiedente e le sue conoscenze specialistiche indicano che l'individuo fornir\u00e0 un contributo significativo e unico all'azienda richiedente.<\/li>\n\n\n\n<li>Le conoscenze specialistiche del richiedente sono specificamente legate a un'esigenza di infrastruttura critica; E<\/li>\n\n\n\n<li>Il richiedente ha trascorso diversi anni con l'azienda all'estero, indicando una conoscenza e un'esperienza sostanziale all'interno dell'organizzazione che pu\u00f2 essere replicata solo da un nuovo dipendente all'interno dell'azienda dopo una formazione approfondita che causerebbe difficolt\u00e0 finanziarie al datore di lavoro.<br><\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Eccezioni: Richiedenti E-2<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Un altro gruppo di titolari di visto che possono essere esentati sono i cittadini stranieri coinvolti in attivit\u00e0 di investimento o commerciali statunitensi di notevole impatto economico, compresi i cittadini stranieri che rientrano nelle classificazioni E-1, Treaty Traders e E-2, Treaty Investors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Procedura per ottenere l'eccezione di interesse nazionale<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I richiedenti che risultano essere soggetti a restrizioni all'ingresso ai sensi dei proclami presidenziali e che risultano essere idonei a ricevere un'eccezione ai sensi delle linee guida del Dipartimento di Stato, devono contattare il consolato statunitense di competenza dove intendono presentare domanda e seguire le procedure del consolato statunitense per richiedere un appuntamento d'emergenza. Il richiedente deve spiegare le ragioni per cui \u00e8 idoneo a ricevere un'eccezione e presentarsi a un colloquio, a meno che non si rinunci al colloquio in base alle linee guida del Dipartimento di Stato del 25 agosto 2020. In precedenza, solo i richiedenti il cui visto non immigrante era scaduto entro 12 mesi potevano beneficiare di un'esenzione dal colloquio. The Department of State has announced that certain travelers from the Schengen Area can apply for a National Interest Exception (\u201cNIE\u201d) allowing entry to the U.S. of certain applicants that meet the NIE guidelines.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>Background<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Since January 2020, a number of\u00a0<a href=\"https:\/\/www.whitehouse.gov\/issues\/immigration\/\" target=\"_blank\" rel=\"noreferrer noopener\">presidential proclamations<\/a>\u00a0have been issued that suspend the entry of aliens who, within the prior 14 days, have been in mainland\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/proclamation-suspension-entry-immigrants-nonimmigrants-persons-pose-risk-transmitting-2019-novel-coronavirus\/\" target=\"_blank\" rel=\"noreferrer noopener\">China<\/a>,\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/proclamation-suspension-entry-immigrants-nonimmigrants-certain-additional-persons-pose-risk-transmitting-coronavirus\/\" target=\"_blank\" rel=\"noreferrer noopener\">Iran<\/a>, the\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/proclamation-suspension-entry-immigrants-nonimmigrants-certain-additional-persons-pose-risk-transmitting-2019-novel-coronavirus\/\" target=\"_blank\" rel=\"noreferrer noopener\">European Schengen Area<\/a>, Ireland, or the\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/proclamation-suspension-entry-immigrants-nonimmigrants-certain-additional-persons-pose-risk-transmitting-coronavirus-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">United Kingdom<\/a>. On June 22, 2020, President Trump issued a\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/proclamation-suspending-entry-aliens-present-risk-u-s-labor-market-following-coronavirus-outbreak\/\" target=\"_blank\" rel=\"noreferrer noopener\">proclamation<\/a>\u00a0stating among other things that\u00a0<em>\u201cthe present admission of workers within several non-immigrant\u00a0visa categories also poses a risk of displacing and disadvantaging United States workers during the current recovery.\u201d<\/em>\u00a0This is an attack on the United States innovation and ability to benefit from attracting talents, investors, and capitals worldwide. Particularly, the H-1B, L-1A, L-1B and E-2 visa programs are critical programs of multinational employment and\u00a0<a href=\"https:\/\/www.cato.org\/blog\/facts-about-l-1-visa-program\" target=\"_blank\" rel=\"noreferrer noopener\">investment growth in an increasingly global marketplace<\/a>. Together, the proclamations extend the immigrant visa ban and bar the entry of foreign citizens requiring work visas in the H-1B, H-2B, L-1, E-2 and many J-1 categories along with their dependents until the end of 2020.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>The Need for Global Mobility<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>There are several US based companies run by foreign executives, managers, talented and skilled employees in L-1A, L-1B, H-1B and E-2 visa. These visas are an excellent mechanism to transfer or bring to a U.S. affiliate, subsidiary, parent or branch of any size, foreign executives, managers, and employees in specialized positions that meet the nowadays, arbitrary visa requirements. These U.S. based companies are funded with substantial foreign investments in the U.S. and offer employment opportunities to U.S. workers. These U.S. companies are not only making every effort to survive in this challenging time, but they are also facing a bigger obstacle as a result of the presidential proclamations suspending the entry to the U.S. of aliens who posses a risk to the U.S. labor market.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>The L Visa: L-1A and L-1B<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p><a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/l-1a-intracompany-transferee-executive-or-manager\" target=\"_blank\" rel=\"noreferrer noopener\">L-1 visa is a non-immigrant visa<\/a>\u00a0which allows foreign companies to transfer employees under two types of L-1 visas. The L-1A visa allows the transfer of executives and managers, including business owners, for up to seven years.\u00a0<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/l-1b-intracompany-transferee-specialized-knowledge\" target=\"_blank\" rel=\"noreferrer noopener\">The L-1B visa for specialized knowledge employees<\/a>\u00a0allows entry for up to five years. Both visas are available under a different set of rules to new or existing U.S. companies. Among other requirements, the\u00a0<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/l-1b-intracompany-transferee-specialized-knowledge\" target=\"_blank\" rel=\"noreferrer noopener\">qualified candidates must have worked for a subsidiary<\/a>, parent, affiliate or branch office of the U.S. company outside of the U.S. for at least one year out of the last three years.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>The E-2 Visa<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>The\u00a0<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/e-2-treaty-investors\" target=\"_blank\" rel=\"noreferrer noopener\">E-2 visa<\/a>\u00a0allows a foreign person who is a national of a\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/us-visas\/visa-information-resources\/fees\/treaty.html\" target=\"_blank\" rel=\"noreferrer noopener\">treaty country<\/a>\u00a0to invest in the U.S. by purchasing an existing business of starting a new business. This visa also allows a U.S. based business to bring foreign executives or managers to the U.S. Whether the E-2 Visa applicant is an employee or the investor, in both cases the applicant must be of the same nationality of the U.S. company. The E-2 foreign employee can be a manager\/supervisor or a worker with special skills making him or her essential to the business.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>H-1B Visa<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>The\u00a0<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/h-1b-specialty-occupations-dod-cooperative-research-and-development-project-workers-and-fashion\" target=\"_blank\" rel=\"noreferrer noopener\">H-1B visa is temporary non-immigrant visa<\/a>\u00a0category that allows U.S. employers, seeking highly skilled foreign employees in specialty occupations -particularly in the Science, Technology, Engineering, and Math fields (STEM)-, to submit petitions for foreign skilled employees. Each year there is a statutory cap of 65,000 visas, with 20,000 additional visas for foreign professionals holding a Master or Doctorate Degree from a U.S. institution. The allocation of H-1B visas and application process is controlled by U.S. Citizenship and Immigration Services (USCIS). These foreign skilled workers play a critical need in the U.S. labor market.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>The Travel Ban<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Since COVID 19 started affecting the United States and countries worldwide, several measurements have been taken in the United States. The United States, as well as many countries, closed their borders, making impossible to travel from or to the U.S. American consulates around the world closed their doors and cancelled appointments. Individuals with approved visas have been unable to make appointments at the U.S. consulates to get their visa stamps. In other cases, visa holders, who were temporarily traveling abroad, have been unable to return to the U.S. due the presidential proclamations. A third group of individuals who were visiting the U.S. when the borders were closed are expecting or wanting to change visa status.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>U.S. Consulates and Embassies: Resume of Visa Services<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>As of July 20, 2020, many US Embassies and Consulates resumed visa services with increasing waiting times due to backlogs. Individuals with approved visas should check the\u00a0<a href=\"https:\/\/www.usembassy.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">US Embassy and Consulate<\/a>\u00a0in their country of origin for latest visa appointment.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>The National Interest Exception and Expansion<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Among other visa types, H-1B, L-1A, L-1B, E-2 visa holders, who, at the time of presidential proclamation were outside of the U.S. and reside in the Schengen Area, are subject to\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/proclamation-suspending-entry-aliens-present-risk-u-s-labor-market-following-coronavirus-outbreak\/\" target=\"_blank\" rel=\"noreferrer noopener\">presidential proclamation 10052<\/a>. This proclamation extends presidential proclamation 10014, which suspended the entry to the United States of certain immigrant visa applicants, through December 31, 2020. However, as of August 12, 2020 and the\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/News\/visas-news\/expansion-of-interview-waiver-eligibility.html\" target=\"_blank\" rel=\"noreferrer noopener\">August 25, 2020 expansion<\/a>, certain immigrants may be able to apply for a\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/News\/visas-news\/exceptions-to-p-p-10014-10052-suspending-entry-of-immigrants-non-immigrants-presenting-risk-to-us-labor-market-during-economic-recovery.html\" target=\"_blank\" rel=\"noreferrer noopener\">national interest exception (NIE)<\/a>\u00a0if they fall under the exceptions listed. The\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/News\/visas-news\/expansion-of-interview-waiver-eligibility.html\" target=\"_blank\" rel=\"noreferrer noopener\">new NIE expansion<\/a>\u00a0allows consular officers to waive the in-person interview requirement for individuals applying for a non-immigrant visa in the same classification.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>Exceptions: L-1A Applicants<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>An L-1A visa applicant may be eligible for an NIE if he or she is seeking to resume ongoing employment in the United States in the same position with the same employer and visa classification.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Another exception is if an applicant for an L-1A visa (new-office L-1A is excluded) may be eligible for an NIE if he or she is a senior-level executive or manager and meets&nbsp;two&nbsp;of the following criteria:<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li>The applicant will be a senior-level executive or manager.<\/li><li>The applicant has spent multiple years with the company overseas, indicating a substantial knowledge and expertise within the organization that can only be replicated by a new employee within the company following extensive training that would cause the employer financial hardship.<\/li><li>The applicant will fill a critical business need for the employer meeting a critical infrastructure need in a designated industry (described above).<br><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:heading -->\n<h2>Exceptions: L-1B Applicants<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>An L-2A applicant may also be eligible for an NIE if the applicant is seeking to resume ongoing employment in the United States in the same position with the same employer and visa classification. Forcing employers to replace employees in this situation may cause undue financial hardship.<br>Another exception is if the applicant is a technical expert or specialist meeting a critical infrastructure need. The consular officer may determine that an L-1B applicant falls into this category if all three of the following indicators are present:<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li>The applicant\u2019s proposed job duties and specialized knowledge indicate the individual will provide significant and unique contributions to the petitioning company.<\/li><li>The applicant\u2019s specialized knowledge is specifically related to a critical infrastructure need; AND<\/li><li>The applicant has spent multiple years with the company overseas, indicating a substantial knowledge and expertise within the organization that can only be replicated by a new employee within the company following extensive training that would cause the employer financial hardship.<br><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:heading -->\n<h2>Exceptions: E-2 Applicants<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Another group of visa holder that may be exempt are foreign nationals involved in U.S. investment or trade activities of substantial economic impact, including foreign nationals under E-1, Treaty Traders and E-2, Treaty Investors non-immigrant classifications.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>Process for Obtaining National Interest Exception<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Applicants who appear to be subject to entry restrictions under the presidential proclamations and also appear to be eligible for an\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/News\/visas-news\/exceptions-to-p-p-10014-10052-suspending-entry-of-immigrants-non-immigrants-presenting-risk-to-us-labor-market-during-economic-recovery.html\" target=\"_blank\" rel=\"noreferrer noopener\">exception under the State Department guidelines<\/a>, must contact the relevant U.S. consulate where they intend to apply and follow the U.S. consulate\u2019s procedures for requesting an emergency appointment. The applicant must state the reasons why he or she is eligible for an exception and appear to an interview, unless the interview is waived under the\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/News\/visas-news\/expansion-of-interview-waiver-eligibility.html\" target=\"_blank\" rel=\"noreferrer noopener\">August 25, 2020, U.S. State Department<\/a>\u00a0guidelines. Previously, only those applicants whose non-immigrant visa expired within 12 months were eligible for an interview waiver. The Secretary has temporarily extended the expiration period to 24 months.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>Foreign Individuals Present in the U.S. Seeking a Change of Visa Status<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Foreign individuals who are in the United States, are unable to travel back to their countries, have maintained lawful status, and meet the pertinent visa requirements, can apply for\u00a0<a href=\"https:\/\/www.uscis.gov\/visit-the-united-states\/change-my-nonimmigrant-status\" target=\"_blank\" rel=\"noreferrer noopener\">a change of visa<\/a>\u00a0with USCIS, to L-1A, L-1B, or E-2 visa, or extend their visas in certain situations.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>Tondini Law Can Help<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Companies continue to be impacted by COVID-19 Pandemic.&nbsp;<a href=\"https:\/\/tondinilaw.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Tondini Law is here<\/a>&nbsp;effectively assisting our clients and addressing the short- and long-term impact on their business.
