We provide assistance with:

US Non-Immigrant Visas:

There are several types of non-immigrant visas which allow a foreign national to work in the United States. They include H-1B (professionals), L (intracompany transferees), E (treaty traders/investors), TN (visas for professionals from Mexico and Canada), F1 (students with practical training) and J (exchange visitor). We have assisted numerous clients in navigating the complexities of regulations, policies and operational instructions to obtain these visas. Issues of current concern include the impact of H-1B quota cap restrictions, portability for H-1B workers, acceptable wage surveys, the interplay between practical training for foreign students and H-1B petitions, changing visa procedures at U.S. embassies worldwide, corporate restructurings, layoffs and terminations, and work authorizations for spouses of L and E visa holders.

TN visa applicants face several challenges, including ensuring that the job position qualifies under the NAFTA/USMCA-approved professions list. Ambiguities or mismatches between job roles, education, and experience can lead to delays or denials. Employers sometimes misclassify roles or misunderstand the process, leading to paperwork issues. Proving that the position is temporary and does not imply immigrant intent can be difficult, particularly when there is uncertainty about future residency plans. Renewals and reapplications also pose challenges if documentation isn’t maintained properly. Additionally, denials at the border or consulate can occur due to insufficient preparation or misinterpretation, and U.S. officials often scrutinize job titles and duties for compliance with regulations.
