Me siento afortunado de que, durante esta \u00e9poca dif\u00edcil, he gestionado ininterrumpidamente mi bufete de abogados y me he mantenido f\u00edsicamente activo. Vivir en una zona residencial y costera abierta me ha dado la oportunidad de salir a dar largas carreras, sin exponerme ni exponer a otros al coronavirus, mientras que en varias partes del mundo la gente estaba confinada en sus casas. En mi profesi\u00f3n, represento a clientes de todo el mundo, en asuntos empresariales y de inmigraci\u00f3n, ya sean peque\u00f1os inversores que expanden su negocio a Am\u00e9rica o empresas multinacionales que se benefician de la movilidad global de la mano de obra. Muchos de mis clientes se han visto afectados de distintas maneras por esta pandemia y las proclamaciones presidenciales que suspenden la entrada de personas extranjeras y restringen la movilidad de su mano de obra a escala mundial. El Departamento de Estado ha anunciado que determinados viajeros del Espacio Schengen pueden solicitar una Excepci\u00f3n por Inter\u00e9s Nacional (\"NIE\") que permita la entrada en EE.UU. de ciertos solicitantes que cumplan las directrices de la NIE.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Fondo<\/h2>\n\n\n\n<p>Desde enero de 2020, se han emitido varias proclamaciones presidenciales que suspenden la entrada de extranjeros que, en los 14 d\u00edas anteriores, hayan estado en China continental, Ir\u00e1n, el Espacio Europeo Schengen, Irlanda o el Reino Unido. El 22 de junio de 2020, el presidente Trump emiti\u00f3 una proclamaci\u00f3n en la que, entre otras cosas, se establec\u00eda lo siguiente\u00a0<em>\"la admisi\u00f3n actual de trabajadores en varias categor\u00edas de visados de no inmigrante tambi\u00e9n plantea el riesgo de desplazar y perjudicar a los trabajadores estadounidenses durante la recuperaci\u00f3n actual\".<\/em>\u00a0Se trata de un ataque a la innovaci\u00f3n de Estados Unidos y a su capacidad para beneficiarse de la atracci\u00f3n de talentos, inversores y capitales de todo el mundo. En particular, los programas de visados H-1B, L-1A, L-1B y E-2 son programas cr\u00edticos de empleo multinacional y\u00a0<a href=\"https:\/\/www.cato.org\/blog\/facts-about-l-1-visa-program\" target=\"_blank\" rel=\"noreferrer noopener\">crecimiento de las inversiones en un mercado cada vez m\u00e1s globalizado<\/a>. Juntas, las proclamaciones ampl\u00edan la prohibici\u00f3n de visados de inmigrante y proh\u00edben la entrada de ciudadanos extranjeros que necesiten visados de trabajo en las categor\u00edas H-1B, H-2B, L-1, E-2 y muchas J-1, junto con sus dependientes, hasta finales de 2020.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La necesidad de movilidad mundial<\/h2>\n\n\n\n<p>Hay varias empresas con sede en EE.UU. dirigidas por ejecutivos, directivos y empleados extranjeros con talento y cualificados con visados L-1A, L-1B, H-1B y E-2. Estos visados son un mecanismo excelente para transferir o traer a una filial, subsidiaria, matriz o sucursal estadounidense de cualquier tama\u00f1o, ejecutivos, directivos y empleados extranjeros en puestos especializados que cumplen los requisitos actuales y arbitrarios del visado. Estas empresas con sede en EE.UU. se financian con importantes inversiones extranjeras en EE.UU. y ofrecen oportunidades de empleo a trabajadores estadounidenses. Estas empresas estadounidenses no s\u00f3lo est\u00e1n haciendo todo lo posible por sobrevivir en estos tiempos dif\u00edciles, sino que tambi\u00e9n se enfrentan a un obst\u00e1culo mayor como consecuencia de las proclamaciones presidenciales que suspenden la entrada en EE.UU. de extranjeros que supongan un riesgo para el mercado laboral estadounidense.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">El visado L: L-1A y L-1B<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/l-1a-intracompany-transferee-executive-or-manager\" target=\"_blank\" rel=\"noreferrer noopener\">El visado L-1 es un visado de no inmigrante<\/a>&nbsp;que permite a las empresas extranjeras trasladar empleados con dos tipos de visados L-1. El visado L-1A permite el traslado de ejecutivos y directivos, incluidos los propietarios de empresas, durante un m\u00e1ximo de siete a\u00f1os.&nbsp;<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/l-1b-intracompany-transferee-specialized-knowledge\" target=\"_blank\" rel=\"noreferrer noopener\">El visado L-1B para empleados con conocimientos especializados<\/a>&nbsp;permite la entrada durante un m\u00e1ximo de cinco a\u00f1os. Este visado tambi\u00e9n permite a una empresa con sede en EE.UU. traer a ejecutivos o directivos extranjeros a EE.UU. Tanto si el solicitante del visado E-2 es un empleado como si es el inversor, en ambos casos el solicitante debe ser de la misma nacionalidad de la empresa estadounidense. El empleado extranjero E-2 puede ser un directivo\/supervisor o un trabajador con aptitudes especiales que le hagan esencial para la empresa.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Visa H-1B<\/h2>\n\n\n\n<p>La&nbsp;<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/h-1b-specialty-occupations-dod-cooperative-research-and-development-project-workers-and-fashion\" target=\"_blank\" rel=\"noreferrer noopener\">El visado H-1B es un visado temporal para no inmigrantes.<\/a>&nbsp;que permite a los empleadores estadounidenses que buscan empleados extranjeros altamente cualificados en ocupaciones especializadas -particularmente en los campos de la ciencia, la tecnolog\u00eda, la ingenier\u00eda y las matem\u00e1ticas (STEM)- presentar peticiones de empleados cualificados extranjeros. Cada a\u00f1o existe un tope legal de 65.000 visados, con 20.000 visados adicionales para profesionales extranjeros que posean un m\u00e1ster o un doctorado de una instituci\u00f3n estadounidense. La asignaci\u00f3n de visados H-1B y el proceso de solicitud est\u00e1n controlados por el Servicio de Ciudadan\u00eda e Inmigraci\u00f3n de EE.UU. (USCIS). Estos trabajadores cualificados extranjeros desempe\u00f1an un papel fundamental en el mercado laboral estadounidense.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La prohibici\u00f3n de viajar<\/h2>\n\n\n\n<p>Desde que COVID 19 empez\u00f3 a afectar a Estados Unidos y a pa\u00edses de todo el mundo, se han tomado varias medidas en EE. Estados Unidos, as\u00ed como muchos pa\u00edses, cerraron sus fronteras, haciendo imposible viajar desde o hacia EE.UU. Los consulados estadounidenses de todo el mundo cerraron sus puertas y cancelaron sus citas. Las personas con visados aprobados no han podido concertar citas en los consulados estadounidenses para obtener sus sellos de visado. En otros casos, los titulares de visados, que viajaban temporalmente al extranjero, no han podido regresar a EE.UU. debido a las proclamaciones presidenciales. Un tercer grupo de personas que estaban de visita en EE.UU. cuando se cerraron las fronteras esperan o desean cambiar de visado.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Consulados y Embajadas de EE.UU: Resumen de los servicios de visado<\/h2>\n\n\n\n<p>A partir del 20 de julio de 2020, muchas Embajadas y Consulados de EE.UU. reanudaron los servicios de visado con tiempos de espera cada vez mayores debido a los retrasos. Las personas con visados aprobados deben comprobar el&nbsp;<a href=\"https:\/\/www.usembassy.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">Embajada y Consulado de EE.UU.<\/a>&nbsp;en su pa\u00eds de origen para la \u00faltima cita de visado.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Excepci\u00f3n de inter\u00e9s nacional y ampliaci\u00f3n<\/h2>\n\n\n\n<p>Entre otros tipos de visado, los titulares de visados H-1B, L-1A, L-1B, E-2, que en el momento de la proclamaci\u00f3n presidencial se encontraban fuera de los EE.UU. y residen en el Espacio Schengen, est\u00e1n sujetos a la proclamaci\u00f3n presidencial 10052. Esta proclamaci\u00f3n prorroga la proclamaci\u00f3n presidencial 10014, que suspend\u00eda la entrada en Estados Unidos de determinados solicitantes de visado de inmigrante, hasta el 31 de diciembre de 2020. Sin embargo, a partir del 12 de agosto de 2020 y la ampliaci\u00f3n del 25 de agosto de 2020, ciertos inmigrantes podr\u00e1n solicitar una excepci\u00f3n por inter\u00e9s nacional (NIE) si entran dentro de las excepciones enumeradas. La nueva ampliaci\u00f3n de la NIE permite a los funcionarios consulares renunciar al requisito de entrevista en persona para las personas que soliciten un visado de no inmigrante en la misma clasificaci\u00f3n.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Excepciones: Solicitantes L-1A<\/h2>\n\n\n\n<p>Un solicitante de visado L-1A puede optar a un NIE si pretende reanudar un empleo continuo en Estados Unidos en el mismo puesto con el mismo empleador y clasificaci\u00f3n de visado.<\/p>\n\n\n\n<p>Otra excepci\u00f3n es que un solicitante de un visado L-1A (los L-1A para nuevas oficinas est\u00e1n excluidos) pueda optar a un NIE si es un alto ejecutivo o directivo y cumple dos de los siguientes criterios:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>El candidato ser\u00e1 un ejecutivo o directivo de alto nivel.<\/li>\n\n\n\n<li>El solicitante ha pasado varios a\u00f1os en la empresa en el extranjero, lo que indica un conocimiento y una experiencia sustanciales dentro de la organizaci\u00f3n que s\u00f3lo pueden ser reproducidos por un nuevo empleado dentro de la empresa tras una formaci\u00f3n exhaustiva que causar\u00eda dificultades financieras al empleador.<\/li>\n\n\n\n<li>El solicitante cubrir\u00e1 una necesidad empresarial cr\u00edtica para el empleador que satisfaga una necesidad de infraestructura cr\u00edtica en una industria designada (descrita anteriormente).<br><\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Excepciones: Solicitantes L-1B<\/h2>\n\n\n\n<p>Un solicitante L-2A tambi\u00e9n puede ser elegible para un NIE si el solicitante est\u00e1 tratando de reanudar el empleo en curso en los Estados Unidos en la misma posici\u00f3n con el mismo empleador y clasificaci\u00f3n de visado. Obligar a los empleadores a sustituir a los empleados en esta situaci\u00f3n puede causar dificultades financieras indebidas.<br>Otra excepci\u00f3n es si el solicitante es un experto o especialista t\u00e9cnico que satisface una necesidad cr\u00edtica de infraestructura. El funcionario consular puede determinar que un solicitante L-1B entra en esta categor\u00eda si se dan los tres indicadores siguientes:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Las funciones propuestas y los conocimientos especializados del solicitante indican que la persona aportar\u00e1 contribuciones significativas y \u00fanicas a la empresa solicitante.<\/li>\n\n\n\n<li>Los conocimientos especializados del solicitante est\u00e1n espec\u00edficamente relacionados con una necesidad de infraestructura cr\u00edtica; Y<\/li>\n\n\n\n<li>El solicitante ha pasado varios a\u00f1os en la empresa en el extranjero, lo que indica un conocimiento y una experiencia sustanciales dentro de la organizaci\u00f3n que s\u00f3lo pueden ser reproducidos por un nuevo empleado dentro de la empresa tras una formaci\u00f3n exhaustiva que causar\u00eda dificultades financieras al empleador.<br><\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Excepciones: Solicitantes E-2<\/h2>\n\n\n\n<p>Otro grupo de titulares de visados que pueden estar exentos son los extranjeros que participen en actividades de inversi\u00f3n o comercio en Estados Unidos de gran repercusi\u00f3n econ\u00f3mica, incluidos los extranjeros acogidos a las clasificaciones de no inmigrantes E-1, Comerciantes por Tratado, y E-2, Inversores por Tratado.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Proceso de obtenci\u00f3n de la excepci\u00f3n de inter\u00e9s nacional<\/h2>\n\n\n\n<p>Los solicitantes que parezcan estar sujetos a restricciones de entrada en virtud de las proclamaciones presidenciales y que tambi\u00e9n parezcan ser elegibles para una excepci\u00f3n en virtud de las directrices del Departamento de Estado, deben ponerse en contacto con el consulado de EE.UU. correspondiente en el que tengan intenci\u00f3n de presentar su solicitud y seguir los procedimientos del consulado de EE.UU. para solicitar una cita de emergencia. El solicitante debe exponer las razones por las que puede acogerse a una excepci\u00f3n y comparecer a una entrevista, a menos que se renuncie a la entrevista en virtud de las directrices del Departamento de Estado de EE.UU. de 25 de agosto de 2020. Anteriormente, s\u00f3lo los solicitantes cuyo visado de no inmigrante caducaba en un plazo de 12 meses pod\u00edan acogerse a una exenci\u00f3n de entrevista. The Department of State has announced that certain travelers from the Schengen Area can apply for a National Interest Exception (\u201cNIE\u201d) allowing entry to the U.S. of certain applicants that meet the NIE guidelines.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>Background<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Since January 2020, a number of\u00a0<a href=\"https:\/\/www.whitehouse.gov\/issues\/immigration\/\" target=\"_blank\" rel=\"noreferrer noopener\">presidential proclamations<\/a>\u00a0have been issued that suspend the entry of aliens who, within the prior 14 days, have been in mainland\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/proclamation-suspension-entry-immigrants-nonimmigrants-persons-pose-risk-transmitting-2019-novel-coronavirus\/\" target=\"_blank\" rel=\"noreferrer noopener\">China<\/a>,\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/proclamation-suspension-entry-immigrants-nonimmigrants-certain-additional-persons-pose-risk-transmitting-coronavirus\/\" target=\"_blank\" rel=\"noreferrer noopener\">Iran<\/a>, the\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/proclamation-suspension-entry-immigrants-nonimmigrants-certain-additional-persons-pose-risk-transmitting-2019-novel-coronavirus\/\" target=\"_blank\" rel=\"noreferrer noopener\">European Schengen Area<\/a>, Ireland, or the\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/proclamation-suspension-entry-immigrants-nonimmigrants-certain-additional-persons-pose-risk-transmitting-coronavirus-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">United Kingdom<\/a>. On June 22, 2020, President Trump issued a\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/proclamation-suspending-entry-aliens-present-risk-u-s-labor-market-following-coronavirus-outbreak\/\" target=\"_blank\" rel=\"noreferrer noopener\">proclamation<\/a>\u00a0stating among other things that\u00a0<em>\u201cthe present admission of workers within several non-immigrant\u00a0visa categories also poses a risk of displacing and disadvantaging United States workers during the current recovery.\u201d<\/em>\u00a0This is an attack on the United States innovation and ability to benefit from attracting talents, investors, and capitals worldwide. Particularly, the H-1B, L-1A, L-1B and E-2 visa programs are critical programs of multinational employment and\u00a0<a href=\"https:\/\/www.cato.org\/blog\/facts-about-l-1-visa-program\" target=\"_blank\" rel=\"noreferrer noopener\">investment growth in an increasingly global marketplace<\/a>. Together, the proclamations extend the immigrant visa ban and bar the entry of foreign citizens requiring work visas in the H-1B, H-2B, L-1, E-2 and many J-1 categories along with their dependents until the end of 2020.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>The Need for Global Mobility<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>There are several US based companies run by foreign executives, managers, talented and skilled employees in L-1A, L-1B, H-1B and E-2 visa. These visas are an excellent mechanism to transfer or bring to a U.S. affiliate, subsidiary, parent or branch of any size, foreign executives, managers, and employees in specialized positions that meet the nowadays, arbitrary visa requirements. These U.S. based companies are funded with substantial foreign investments in the U.S. and offer employment opportunities to U.S. workers. These U.S. companies are not only making every effort to survive in this challenging time, but they are also facing a bigger obstacle as a result of the presidential proclamations suspending the entry to the U.S. of aliens who posses a risk to the U.S. labor market.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>The L Visa: L-1A and L-1B<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p><a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/l-1a-intracompany-transferee-executive-or-manager\" target=\"_blank\" rel=\"noreferrer noopener\">L-1 visa is a non-immigrant visa<\/a>\u00a0which allows foreign companies to transfer employees under two types of L-1 visas. The L-1A visa allows the transfer of executives and managers, including business owners, for up to seven years.\u00a0<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/l-1b-intracompany-transferee-specialized-knowledge\" target=\"_blank\" rel=\"noreferrer noopener\">The L-1B visa for specialized knowledge employees<\/a>\u00a0allows entry for up to five years. Both visas are available under a different set of rules to new or existing U.S. companies. Among other requirements, the\u00a0<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/l-1b-intracompany-transferee-specialized-knowledge\" target=\"_blank\" rel=\"noreferrer noopener\">qualified candidates must have worked for a subsidiary<\/a>, parent, affiliate or branch office of the U.S. company outside of the U.S. for at least one year out of the last three years.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>The E-2 Visa<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>The\u00a0<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/e-2-treaty-investors\" target=\"_blank\" rel=\"noreferrer noopener\">E-2 visa<\/a>\u00a0allows a foreign person who is a national of a\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/us-visas\/visa-information-resources\/fees\/treaty.html\" target=\"_blank\" rel=\"noreferrer noopener\">treaty country<\/a>\u00a0to invest in the U.S. by purchasing an existing business of starting a new business. This visa also allows a U.S. based business to bring foreign executives or managers to the U.S. Whether the E-2 Visa applicant is an employee or the investor, in both cases the applicant must be of the same nationality of the U.S. company. The E-2 foreign employee can be a manager\/supervisor or a worker with special skills making him or her essential to the business.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>H-1B Visa<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>The\u00a0<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/h-1b-specialty-occupations-dod-cooperative-research-and-development-project-workers-and-fashion\" target=\"_blank\" rel=\"noreferrer noopener\">H-1B visa is temporary non-immigrant visa<\/a>\u00a0category that allows U.S. employers, seeking highly skilled foreign employees in specialty occupations -particularly in the Science, Technology, Engineering, and Math fields (STEM)-, to submit petitions for foreign skilled employees. Each year there is a statutory cap of 65,000 visas, with 20,000 additional visas for foreign professionals holding a Master or Doctorate Degree from a U.S. institution. The allocation of H-1B visas and application process is controlled by U.S. Citizenship and Immigration Services (USCIS). These foreign skilled workers play a critical need in the U.S. labor market.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>The Travel Ban<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Since COVID 19 started affecting the United States and countries worldwide, several measurements have been taken in the United States. The United States, as well as many countries, closed their borders, making impossible to travel from or to the U.S. American consulates around the world closed their doors and cancelled appointments. Individuals with approved visas have been unable to make appointments at the U.S. consulates to get their visa stamps. In other cases, visa holders, who were temporarily traveling abroad, have been unable to return to the U.S. due the presidential proclamations. A third group of individuals who were visiting the U.S. when the borders were closed are expecting or wanting to change visa status.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>U.S. Consulates and Embassies: Resume of Visa Services<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>As of July 20, 2020, many US Embassies and Consulates resumed visa services with increasing waiting times due to backlogs. Individuals with approved visas should check the\u00a0<a href=\"https:\/\/www.usembassy.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">US Embassy and Consulate<\/a>\u00a0in their country of origin for latest visa appointment.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>The National Interest Exception and Expansion<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Among other visa types, H-1B, L-1A, L-1B, E-2 visa holders, who, at the time of presidential proclamation were outside of the U.S. and reside in the Schengen Area, are subject to\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/proclamation-suspending-entry-aliens-present-risk-u-s-labor-market-following-coronavirus-outbreak\/\" target=\"_blank\" rel=\"noreferrer noopener\">presidential proclamation 10052<\/a>. This proclamation extends presidential proclamation 10014, which suspended the entry to the United States of certain immigrant visa applicants, through December 31, 2020. However, as of August 12, 2020 and the\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/News\/visas-news\/expansion-of-interview-waiver-eligibility.html\" target=\"_blank\" rel=\"noreferrer noopener\">August 25, 2020 expansion<\/a>, certain immigrants may be able to apply for a\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/News\/visas-news\/exceptions-to-p-p-10014-10052-suspending-entry-of-immigrants-non-immigrants-presenting-risk-to-us-labor-market-during-economic-recovery.html\" target=\"_blank\" rel=\"noreferrer noopener\">national interest exception (NIE)<\/a>\u00a0if they fall under the exceptions listed. The\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/News\/visas-news\/expansion-of-interview-waiver-eligibility.html\" target=\"_blank\" rel=\"noreferrer noopener\">new NIE expansion<\/a>\u00a0allows consular officers to waive the in-person interview requirement for individuals applying for a non-immigrant visa in the same classification.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>Exceptions: L-1A Applicants<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>An L-1A visa applicant may be eligible for an NIE if he or she is seeking to resume ongoing employment in the United States in the same position with the same employer and visa classification.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Another exception is if an applicant for an L-1A visa (new-office L-1A is excluded) may be eligible for an NIE if he or she is a senior-level executive or manager and meets&nbsp;two&nbsp;of the following criteria:<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li>The applicant will be a senior-level executive or manager.<\/li><li>The applicant has spent multiple years with the company overseas, indicating a substantial knowledge and expertise within the organization that can only be replicated by a new employee within the company following extensive training that would cause the employer financial hardship.<\/li><li>The applicant will fill a critical business need for the employer meeting a critical infrastructure need in a designated industry (described above).<br><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:heading -->\n<h2>Exceptions: L-1B Applicants<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>An L-2A applicant may also be eligible for an NIE if the applicant is seeking to resume ongoing employment in the United States in the same position with the same employer and visa classification. Forcing employers to replace employees in this situation may cause undue financial hardship.<br>Another exception is if the applicant is a technical expert or specialist meeting a critical infrastructure need. The consular officer may determine that an L-1B applicant falls into this category if all three of the following indicators are present:<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li>The applicant\u2019s proposed job duties and specialized knowledge indicate the individual will provide significant and unique contributions to the petitioning company.<\/li><li>The applicant\u2019s specialized knowledge is specifically related to a critical infrastructure need; AND<\/li><li>The applicant has spent multiple years with the company overseas, indicating a substantial knowledge and expertise within the organization that can only be replicated by a new employee within the company following extensive training that would cause the employer financial hardship.<br><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:heading -->\n<h2>Exceptions: E-2 Applicants<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Another group of visa holder that may be exempt are foreign nationals involved in U.S. investment or trade activities of substantial economic impact, including foreign nationals under E-1, Treaty Traders and E-2, Treaty Investors non-immigrant classifications.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>Process for Obtaining National Interest Exception<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Applicants who appear to be subject to entry restrictions under the presidential proclamations and also appear to be eligible for an\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/News\/visas-news\/exceptions-to-p-p-10014-10052-suspending-entry-of-immigrants-non-immigrants-presenting-risk-to-us-labor-market-during-economic-recovery.html\" target=\"_blank\" rel=\"noreferrer noopener\">exception under the State Department guidelines<\/a>, must contact the relevant U.S. consulate where they intend to apply and follow the U.S. consulate\u2019s procedures for requesting an emergency appointment. The applicant must state the reasons why he or she is eligible for an exception and appear to an interview, unless the interview is waived under the\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/News\/visas-news\/expansion-of-interview-waiver-eligibility.html\" target=\"_blank\" rel=\"noreferrer noopener\">August 25, 2020, U.S. State Department<\/a>\u00a0guidelines. Previously, only those applicants whose non-immigrant visa expired within 12 months were eligible for an interview waiver. The Secretary has temporarily extended the expiration period to 24 months.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>Foreign Individuals Present in the U.S. Seeking a Change of Visa Status<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Foreign individuals who are in the United States, are unable to travel back to their countries, have maintained lawful status, and meet the pertinent visa requirements, can apply for\u00a0<a href=\"https:\/\/www.uscis.gov\/visit-the-united-states\/change-my-nonimmigrant-status\" target=\"_blank\" rel=\"noreferrer noopener\">a change of visa<\/a>\u00a0with USCIS, to L-1A, L-1B, or E-2 visa, or extend their visas in certain situations.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2>Tondini Law Can Help<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Companies continue to be impacted by COVID-19 Pandemic.&nbsp;<a href=\"https:\/\/tondinilaw.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Tondini Law is here<\/a>&nbsp;effectively assisting our clients and addressing the short- and long-term impact on their business.
