La ley de inmigraci\u00f3n estadounidense pone visados a disposici\u00f3n de los inmigrantes inversores que deseen entrar en Estados Unidos para emprender nuevas empresas comerciales que beneficien a la econom\u00eda estadounidense mediante la creaci\u00f3n de empleo y la inversi\u00f3n de capital. Los dos visados para inversores m\u00e1s comunes -y bastante diferentes- son EB-5<\/a> y E-2<\/a> visado. <\/p>\n\n\n\n

Uno de los requisitos del visado es que el inversor haya adquirido los fondos de fuentes l\u00edcitas, como ahorros personales, ganancias de inversiones, regalos, herencias, ingresos de la venta de propiedades, negocios o venta de criptodivisas (en determinadas circunstancias). <\/p>\n\n\n\n

Comprender si la criptomoneda puede utilizarse como fuente de fondos para E-2<\/a> visados, es importante entender cierta terminolog\u00eda.<\/p>\n\n\n\n

\u00bfQu\u00e9 es la criptomoneda?<\/strong><\/h2>\n\n\n\n

La criptomoneda es un instrumento digital o moneda virtual<\/a> que est\u00e1 asegurada por criptograf\u00eda y utiliza tecnolog\u00eda de igual a igual para funcionar sin autoridad central ni bancos; la gesti\u00f3n de las transacciones y la emisi\u00f3n de criptodivisas se lleva a cabo colectivamente por la red. <\/p>\n\n\n\n

A\u00a0cripto\u00a0<\/strong>cartera<\/a>\u00a0es un monedero virtual o digital donde la gente almacena sus criptodivisas para mantenerlas seguras. Existen diferentes tipos de monederos:<\/p>\n\n\n\n

    Cryptocurrency is based on a blockchain, which is a system in which a record of transactions in Bitcoin or any other cryptocurrencies are maintained across several computers that are linked in a peer-to-peer network. Blockchain is the underlying technology of cryptocurrency that keeps the system secure and is the main reason why cryptocurrency is such a big deal. It's the backbone of the whole operation. A series of blocks make up a block chain within each block are a series of transactions.<\/p>\n\n\n\n

    The first Bitcoin<\/a> was the very first cryptocurrency invented in 2008 by an unknown person or group of people using their name Satoshi Nakamoto<\/a>. Since then, several other cryptocurrencies, tokens and NFTs have been created: Ethereum<\/a>, Litecoin<\/a>, Cardano<\/a>, Polkadot<\/a>, Bitcoin Cash<\/a>, Dogecoin<\/a> and more. <\/p>\n\n\n\n

    What is a crypto wallet?<\/strong><\/h2>\n\n\n\n

    A crypto wallet<\/strong><\/a> is a virtual or digital wallet where people store their cryptocurrency to keep it safe.\u00a0There are different types of wallets:<\/p>\n\n\n\n

    1. Software wallet<\/strong> is a software used on your desktop or mobile phone similar to a digital bank account for your cryptocurrencies, in order to manage, send and receive your coins. Gemini<\/a>, BlockFi<\/a>,\u00a0ZenGo<\/a>.\u00a0<\/li>
    2. Web Wallet<\/strong> is also called \u201chot wallet\u201d and hosted by third partis such as cryptocurrency exchanges online for convenience. For example, a popular web wallet is Coinbase<\/a>.<\/li>
    3. Cold wallet<\/strong> is any type of wallet that is not connected to the internet, such as paper wallet or USB drive<\/li>
    4. Hardware wallet<\/strong> is a device specifically designed to safely store cryptocurrencies.\u00a0They are probably the safest way to store cryptocurrencies.\u00a0<\/li><\/ol>\n\n\n\n

      Every cryptocurrency wallet has a public key<\/strong> and a private key<\/strong>. <\/p>\n\n\n\n

      Public Key<\/a> is used to receive funds. It identifies your account on the network and it can be searched in the ledger.<\/p>\n\n\n\n

      Private Key<\/a> is only used to sign transactions and prove you own the related public key. <\/p>\n\n\n\n

      Why was cryptocurrency created?<\/strong><\/h2>\n\n\n\n

      Satoshi Nakamoto wrote \u201cthe brute problem with conventional currency is all the trust that's required to make it work<\/em>.\u201d<\/p>\n\n\n\n

      The main purpose of cryptocurrency was to create a new way of payment that could be used internationally and globally. It could be decentralized without having any financial institution behind it and have a set limited supply of it. <\/p>\n\n\n\n

      The first step in the analysis is to know if<\/strong> crypto transactions are legal in the jurisdiction where it was purchased or transacted. This requires investigating if there is any regulatory framework for crypto currencies exchanges and any tax implications.<\/p>\n\n\n\n

      The United States<\/strong> hasn\u2019t yet developed a clear regulatory framework for the asset class.\u00a0What is clear, so far, is that the\u00a0Internal Revenue Service (IRS)<\/a>\u00a0classifies cryptocurrencies as property for federal income tax purposes and are subject to short-term and long-term capital gains.<\/p>\n\n\n\n

      Canada<\/strong> regulators have generally taken a proactive stance toward crypto in Canada. It became the first country to approve a Bitcoin exchange-traded fund<\/a> (ETF) in February 2021. Additionally, the Canadian Securities Administrators (CSA)<\/a> and the Investment Industry Regulatory Organization of Canada (IIROC) have clarified that crypto trading platforms and dealers in the country must register with provincial regulators. Furthermore, Canada classifies crypto investment firms as money service businesses (MSBs) and requires that they register with the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC)<\/a>. From a taxation standpoint, Canada treats cryptocurrency similar to other commodities.<\/p>\n\n\n\n

      The United Kingdom<\/strong> considers cryptocurrency as property but not legal tender. Additionally, cryptocurrency exchanges must register with the U.K. Financial Conduct Authority (FCA)<\/a> and are banned from offering crypto derivatives trading. Moreover, the regulatory body has introduced cryptocurrency-specific requirements relating to know your customer (KYC)<\/a>, as well as to the above-mentioned AML and CFT. Although investors still pay capital gains tax<\/a> on crypto trading profits, more broadly, taxability depends on the crypto activities undertaken and who engages in the transaction.<\/p>\n\n\n\n

      Similarly to the United Kingdom, Singapore<\/strong> classifies cryptocurrency as property but not legal tender. The country\u2019s Monetary Authority of Singapore (MAS) licenses and regulates exchanges as outlined in the Payment Services Act (PSA). Singapore, in part, gets its reputation as a cryptocurrency safe haven<\/a> because long-term capital gains are not taxed. However, the country taxes companies that regularly transact in cryptocurrency, treating gains as income.<\/p>\n\n\n\n

      Cryptocurrency is legal throughout most of the\u00a0European Union (EU)<\/a>, although exchange governance depends on individual member states. Meanwhile, taxation also varies by country within the EU, ranging from 0% to 50%. In recent years, the EU\u2019s\u00a0Fifth and Sixth Anti-Money Laundering Directives\u00a0(5AMLD and 6AMLD) have come into effect, which tighten KYC\/CFT obligations and standard reporting requirements. In September 2020, the European Commission proposed the\u00a0Markets in Crypto-Assets Regulation\u00a0(MiCA)\u2014a framework that increases\u00a0consumer protections<\/a>, establishes clear crypto industry conduct, and introduces new licensing requirements.<\/p>\n\n\n\n

      Proving identity and ownership of proceeds from sale of cryptocurrency<\/strong>.<\/h2>\n\n\n\n

      This analysis may present different scenarios, some more complex than others.
