La descripci\u00f3n del puesto y la oferta de trabajo son una oportunidad laboral de buena fe abierta a todos los trabajadores cualificados. El empresario no puede haber contratado a trabajadores menos cualificados para puestos sustancialmente similares.<\/p>\n\n\n\n<p>Durante este proceso, el&nbsp;<a href=\"https:\/\/tondinilaw.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">abogado<\/a>El Ministerio de Trabajo y Asuntos Sociales, que gestiona la certificaci\u00f3n laboral PERM, tiene una participaci\u00f3n limitada y puede facilitar una lista de control para guiar el proceso de contrataci\u00f3n, proporcionar recursos (<a href=\"https:\/\/www.onetonline.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">O*Net<\/a>,&nbsp;<a href=\"https:\/\/www.bls.gov\/ooh\/\" target=\"_blank\" rel=\"noreferrer noopener\">OOH<\/a>,&nbsp;<a href=\"https:\/\/www.dol.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">DOL<\/a>) para ayudar a los empresarios a determinar los requisitos m\u00ednimos del puesto de trabajo y la descripci\u00f3n del mismo, revisar la publicidad y presentar el&nbsp;<a href=\"https:\/\/www.dol.gov\/agencies\/eta\/foreign-labor\/wages\/prevailing-wage\" target=\"_blank\" rel=\"noreferrer noopener\">determinaci\u00f3n del salario prevaleciente al DOL<\/a>&nbsp;bas\u00e1ndose en la informaci\u00f3n facilitada por el empresario.<\/p>\n\n\n\n<p>El primer paso en el patrocinio de la tarjeta verde basada en el empleo es obtener el&nbsp;<a href=\"https:\/\/www.dol.gov\/agencies\/eta\/foreign-labor\/programs\/permanent\" target=\"_blank\" rel=\"noreferrer noopener\">Certificaci\u00f3n laboral PERM<\/a>. Se rige por&nbsp;<a href=\"https:\/\/www.govinfo.gov\/app\/details\/CFR-2011-title20-vol3\/CFR-2011-title20-vol3-part656\" target=\"_blank\" rel=\"noreferrer noopener\">20 CFR 656<\/a>&nbsp;e incluye dos pasos principales:<\/p>\n\n\n\n<p><strong>Prueba del mercado laboral:<\/strong><\/p>\n\n\n\n<p>Durante este proceso, el empleador estadounidense debe demostrar a trav\u00e9s del proceso de contrataci\u00f3n, que no hay suficientes trabajadores dispuestos, disponibles y cualificados ya en los EE.UU. que est\u00e9n cualificados para el puesto ofrecido al extranjero. Este es el proceso requerido para comprobar el mercado laboral estadounidense. El empleador debe anunciar el puesto, revisar los curr\u00edculos y documentar todo el proceso de contrataci\u00f3n durante m\u00e1s de 30 d\u00edas pero menos de 180 d\u00edas antes de presentar la solicitud para asegurarse de que no hay trabajos estadounidenses disponibles para el puesto. El proceso de contrataci\u00f3n debe realizarse conforme a la ley.<\/p>\n\n\n\n<p><strong>Determinaci\u00f3n del salario compensatorio:<\/strong><\/p>\n\n\n\n<p>El empleador debe ofrecer al menos el salario vigente para el puesto y demostrar que la contrataci\u00f3n de un extranjero no afectar\u00e1 a los salarios y condiciones de trabajo de los trabajadores estadounidenses en situaci\u00f3n similar. El salario prevaleciente debe obtenerse antes de presentar la solicitud PERM en el sitio web del DOL utilizando el enlace&nbsp;<a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/ETA\/oflc\/pdfs\/ETA_Form_9141.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ETA 9141<\/a>&nbsp;forma.<br>&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. La solicitud de visado de inmigrante I-140 del empleador y la prueba de la capacidad para pagar el salario ofrecido.<\/h2>\n\n\n\n<p>Tras obtener la aprobaci\u00f3n del&nbsp;<a href=\"https:\/\/www.dol.gov\/agencies\/eta\/foreign-labor\/programs\/permanent\" target=\"_blank\" rel=\"noreferrer noopener\">Certificaci\u00f3n laboral PERM<\/a>&nbsp;por el DOL el empresario debe&nbsp;<a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/visa-availability-and-priority-dates\" target=\"_blank\" rel=\"noreferrer noopener\">formulario I 140<\/a>, Petici\u00f3n de Inmigrante para Trabajador Extranjero dentro de los seis meses siguientes a la aprobaci\u00f3n de la certificaci\u00f3n laboral.<\/p>\n\n\n\n<p>Durante este tiempo, el empleador est\u00e1 obligado a demostrar su capacidad para pagar el salario ofrecido a partir de la fecha de la PERM fue presentada. En este punto del proceso, el empleador s\u00f3lo atestigua la capacidad de pagar el salario, pero no tiene que pagar dicho salario.<\/p>\n\n\n\n<p>Si USCIS tiene alguna preocupaci\u00f3n acerca de esto, puede requerir que el empleador establezca la capacidad financiera para pagar este salario a partir de la fecha en que el trabajo PERM fue presentado. Por lo tanto, se espera que el empleador proporcione informes anuales, declaraciones de impuestos, y \/ o estados financieros auditados, y otros tipos de registros. Si el empleador tiene bajos beneficios netos de explotaci\u00f3n, o sus ingresos netos son bajos durante varios a\u00f1os, y no puede demostrar su capacidad para pagar el salario propuesto, sin duda surgir\u00e1n complicaciones en el proceso, y tal vez desencadenar una denegaci\u00f3n.<\/p>\n\n\n\n<p>La presentaci\u00f3n del formulario I 140 dar\u00e1 al extranjero un&nbsp;<a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/visa-availability-and-priority-dates\" target=\"_blank\" rel=\"noreferrer noopener\">fecha de prioridad<\/a>. Ajuste de Estatus. El \u00faltimo paso en el proceso de residencia permanente.<\/h2>\n\n\n\n<p>El \u00faltimo paso en el proceso de residencia permanente basada en el empleo es la presentaci\u00f3n del&nbsp;<a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/adjustment-of-status\" target=\"_blank\" rel=\"noreferrer noopener\">Adaptaci\u00f3n del estatuto<\/a>&nbsp;para el extranjero y las personas a su cargo.
